Yusuf S V. State Of Karnataka – Quashing Of Criminal Proceedings / Requirement Of Reasons In Judicial Orders

Code of Criminal Procedure 1973 - Section 482 - Judgments - Duty to Give Reasons - The principal objective in giving judgment is to make an effective, practical and workable decision and while recording the decision with clarity, the Court is also supposed to record sufficient reason in taking a particular decision or arriving at a particular conclusion and the reasons should be such that they demonstrate that the decision has been arrived at on an objective consideration. (Para 12) [Context: The Supreme Court sets aside a High Court order which had quashed an FIR on the ground that the order was cryptic and lacked reasons. It holds that the absence of reasons in the impugned order itself is sufficient to warrant interference. ]
